Terms of Use

1. Acceptance of Terms

By accessing or using Retorno ("Service"), available at https://retorno.io, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These Terms constitute a binding agreement between you ("User") and the operator identified in Section 13.

2. Description of the Service

Retorno is an AI-powered outreach agent that automates LinkedIn and email cold outreach for solo founders and agencies. The Service analyzes your Ideal Customer Profile (ICP), enriches prospect data, and manages outreach campaigns on your behalf.

Closed Beta Notice: The Service is currently in closed beta. Features, availability, and pricing are subject to change without prior notice. No uptime or performance guarantees are provided during the beta period.

3. Account and Eligibility

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information during registration.

4. Acceptable Use

You agree to:

  • Comply with all applicable laws, including anti-spam legislation (CAN-SPAM, LGPD, etc.).
  • Comply with LinkedIn's Terms of Service and any third-party platform policies.
  • Not use the Service to send unsolicited bulk messages that violate platform rules.
  • Not attempt to reverse-engineer, scrape, or exploit the Service beyond its intended functionality.
  • Not impersonate another person or entity through the Service.

Violation of this section may result in immediate account termination.

5. Third-Party Integrations

By using the Service, you authorize Retorno to:

  • Access and act on behalf of your LinkedIn account via Unipile integration.
  • Send emails on your behalf via Resend.
  • Enrich prospect data using Apollo.io and Firecrawl.
  • Process your data using Claude API (Anthropic) for ICP inference and message generation.

You acknowledge that these integrations are subject to the respective third-party terms and that Retorno is not liable for third-party service interruptions or policy changes.

6. Payments and Subscriptions

During the closed beta, the Service is provided free of charge. Future paid tiers will be offered in USD and/or BRL, with pricing communicated before any charges apply. Subscription terms, billing cycles, and refund policies will be detailed at launch of paid plans.

7. Intellectual Property

All rights in the Service — including software, design, trademarks, and documentation — belong to the operator. You retain ownership of your own content (e.g., ICP data, contact lists). By using the Service, you grant Retorno a limited license to process your content solely to deliver the Service.

8. Indemnification

You agree to indemnify and hold harmless the operator, its officers, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Limitation of Liability

To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. During the beta period, the Service is provided "as is" without warranties of any kind.

10. Termination

Either party may terminate this agreement at any time. The operator may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases, and the operator may delete your data after a 30-day retention period.

11. Modifications to Terms

The operator reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be submitted to the courts of the jurisdiction where the operator's registered office is located, to the exclusion of any other, however privileged.
